Terms and Conditions

This legal document (“Agreement”) is concluded between the business hereinafter referred to as “Metkart” and the natural or legal person hereinafter referred to as “Customer” who uses the Metkart website, procures products or services, and governs the rights and obligations of the parties.


1. GENERAL PROVISIONS AND DEFINITIONS

1.1 Metkart is not a bank as defined in the Banking Law or a payment institution as defined in the Law on Payment and Securities Settlement Systems, Payment Services and Electronic Money Institutions. Metkart does not have the authority to issue cards or operate payment systems.

1.2 Metkart shall not be held liable in any way for any direct, indirect, incidental, special, punitive, or consequential damages that may arise as a result of accessing this website, using the information on the site, or procuring any product or service through the site, whether in electronic or physical form.

1.3 Metkart cannot be held responsible for any damage, loss, or harm arising from breach of contract, tort, negligence, or other legal causes, including but not limited to:

  • Temporary or permanent interruption, disruption, or complete cessation of transactions,
  • Human error, technical failure, negligence, intentional interference, data deletion or modification,
  • Loss of information, breach of data integrity, communication delay or disruption,
  • Computer viruses, malicious software, errors in communication infrastructure, unauthorized access incidents, or interventions by third parties.

1.4 Metkart exclusively reserves the right to change, modify, reorganize, suspend, or completely cease the publication of these terms of use, information, services, products, and content offered on the site, at its sole discretion, without any prior notice. Changes, modifications, and arrangements shall automatically take effect and produce their consequences from the moment they are published on the site, and the Customer has no right to make any request or objection to the contrary.

1.5 These terms of use also apply to third-party websites accessed through external links (hyperlinks) on the Metkart website. However, Metkart cannot be held responsible in any way for the content, accuracy, security, and currency of such third-party websites and does not have any control authority over these sites.


2. INTELLECTUAL PROPERTY RIGHTS AND COPYRIGHT

2.1 The design, visual elements, logos, trademarks, written content, codes, images, and all materials of the Metkart website are the exclusive property of Metkart under the Intellectual Property Law, Industrial Property Law, and relevant legislation, and are protected by law. These materials and content cannot be used, reproduced, processed, or published in any way without the express written permission of Metkart.

2.2 No material, content, or element on the Metkart website may, without the prior express written permission of Metkart:

  • Be changed, modified, or subjected to any disposition,
  • Be partially or fully reproduced, copied, or replicated,
  • Have its source code accessed, interfered with, or deciphered,
  • Be publicly published, distributed, exhibited, or used for commercial purposes.

2.3 Metkart reserves all intellectual and industrial property rights not expressly stated above and has the right to pursue legal and criminal remedies under all relevant legislation in case of infringement of these rights.


3. CUSTOMER OBLIGATIONS AND COMMITMENTS

3.1 The Customer irrevocably declares, accepts, and undertakes the following regarding all content (photographs, visuals, logos, designs, drawings, etc.) submitted to Metkart or uploaded to the website during the ordering process and service procurement:

  • That all intellectual property rights of said content belong to the Customer or that the content is already in the public domain,
  • That the content does not infringe any third party’s copyrights, intellectual property rights, personality rights, or any legal rights,
  • That the content does not violate the rights, honor and dignity, privacy, or protection of personal data of third parties,
  • That the content does not contain any elements that are illegal, obscene, threatening, harassing, defamatory, or otherwise constitute a criminal offense.

3.2 The Customer accepts, declares, and undertakes that all responsibility rests exclusively with the Customer in case of legal disputes, conflicts, or legal proceedings that may arise with any license holder, rights holder, or third parties due to the designs, visuals, or content used. In this context, the Customer agrees to immediately and fully compensate Metkart for any damage, compensation, penalty, litigation expense, and attorney’s fee that Metkart may be exposed to upon first request.

3.3 Unauthorized use of content covered by third parties’ copyrights, trademarks, patents, or other intellectual property rights may result in legal and criminal consequences under the relevant intellectual property legislation. All legal and criminal responsibility in such cases belongs to the Customer, and Metkart has no responsibility.

3.4 The Customer accepts, declares, and undertakes that they will only use the metal card service provided by Metkart on payment cards, identity cards, membership cards, loyalty cards, or other card-like products for which they have exclusive right of disposition that have been legally issued to them; that they will not use any card belonging to another person, obtained against their will, stolen, lost, found, forged, counterfeit, or tampered with; and that they will not engage in any action that would constitute a crime under the current criminal laws.

3.5 The Customer declares that they understand and accept that the card modification they perform using Metkart products and services does not fall within the scope of the legally prohibited acts of “producing, selling, transferring, purchasing, or accepting fake bank or credit cards associated with other people’s bank accounts,” as no new card production or copying process is performed as a result of the transaction, only the physical appearance of the Customer’s own legal payment card is changed.


4. SERVICE TERMS AND WARRANTY CONDITIONS

4.1 Metkart does not offer any return or exchange guarantee for products or services sold, unless otherwise agreed and unless required by relevant legislation. The Customer is deemed to have expressly accepted this.

4.2 The following conditions apply to the Do-It-Yourself Metal Card Conversion Kit and service:

  • This kit is designed only for converting cards with EMV chip technology to metal cards; cards without chips are not suitable for this process.
  • The metal card conversion process is performed by the Customer themselves using the Do-It-Yourself Kit, and the Customer transfers the EMV chip from their card to the metal card on their own. Metkart does not perform this transfer process on behalf of the Customer.
  • As a result of this conversion process performed at the Customer’s own discretion, the intervention on the original plastic card may render the plastic card technically unusable. The Customer accepts this situation and undertakes not to claim any compensation, refund, or new card from Metkart.
  • The metal card conversion process only means changing the physical properties of the card and consists of the physical transfer of the EMV chip by the Customer at their own responsibility. This process does not involve any change, copying, or reproduction of the card’s electronic properties or data.
  • The Customer agrees to perform the metal card conversion process with the Do-It-Yourself Kit within their own knowledge, skill, and responsibility. Metkart is not responsible for card damage or loss of function that may occur due to the Customer’s incorrect applications or failure to follow instructions.

4.3 The Metal Card created by Metkart is envisaged to be used under the following conditions:

  • The use of the Metal Card in ATMs (Automated Teller Machines) is not recommended, and the Customer accepts that they will be responsible for any card damage, jamming, damage to the ATM, or similar situations resulting from use in ATMs.
  • No guarantee or assurance is provided by Metkart for any problem, malfunction, damage, or transaction error that may occur during ATM use.
  • As the Metal Card may differ from standard bank/credit cards in terms of physical properties such as weight and thickness, the Customer should exercise maximum care and diligence when using it in POS terminals and other card readers.

4.4 In cases of loss, theft, or any unauthorized use, the bank or financial institution that is the Customer’s credit card/bank card provider is the sole authorized entity, and Metkart has no authority to intervene, cancel, block, or recover in such situations. The Customer should contact the card provider institution directly in such cases.

4.5 The services provided by Metkart do not constitute any banking or payment service under the Banking Law or the Law on Payment Services and Electronic Money Institutions. Metkart only provides a service to change the physical properties of an existing payment card and does not make any changes to its electronic properties.


5. DELIVERY, SECURITY, AND RISK

5.1 When sending their card to Metkart, the Customer accepts and undertakes the following:

  • The secure, sturdy, and proper packaging of the card is entirely the Customer’s responsibility, and Metkart is not responsible for any loss, damage, or delays that may occur during the delivery process to Metkart.
  • The Customer is obligated to close their card to online transactions, automatic payments, and physical use from the moment they send their card to Metkart until they receive it back, or to be personally responsible for any transactions that may occur during this period.
  • The Customer declares that they are aware of and accept the risks that may occur during card delivery and receipt.

5.2 Metkart is obligated to take all reasonable and necessary precautions regarding the security of card information throughout the delivery process. However, Metkart cannot be held responsible in any way for damages, losses, or unauthorized transactions that may arise as a result of the Customer’s neglect or incomplete application of the measures specified above.

5.3 Regarding the printing of card information on the metal card, the Customer accepts, declares, and undertakes the following:

  • The Customer expressly declares and undertakes that all information provided in the Card Information Form legally belongs to them, that this information is accurate, and that they are not using card information belonging to someone else.
  • Metkart collects the information provided by the Customer in the Card Information Form solely for visual use on the metal card, does not verify the accuracy or authenticity of this information, and under no circumstances integrates it with banking systems or uses it for payment transactions. This information is used only as visual elements for the purpose of producing personalized metal cards.
  • The Customer acknowledges that the choice to have card information printed on the metal card is at their own personal responsibility and that they are aware that different card providers may have different terms of use regarding this matter.
  • The Customer acknowledges that they are aware of the possibility that information printed on the metal card may be viewed, copied, or used by third parties for malicious or illegal purposes, and accepts that they assume all risks and responsibilities that may arise from such situations.
  • The Customer accepts and declares that if the information on the metal card is used in illegal activities or for fraudulent purposes, Metkart cannot be held responsible in any way for these actions, and all legal, criminal, and financial responsibility belongs exclusively to the Customer.
  • Metkart reserves the right to reject the order and not perform the transaction, without providing any reason, in cases it deems suspicious or if there is a belief that printing card information on the metal card may constitute a crime.
  • The Customer undertakes that the information printed on the metal card will not be used for producing counterfeit cards or duplicating cards, and accepts that all legal and criminal responsibility arising from contrary actions belongs to them.

5.4 The Customer acknowledges and declares that they know that producing, selling, transferring, purchasing, or accepting fake bank or credit cards associated with other people’s bank accounts constitutes a crime under criminal legislation, and that they will only use Metkart services on payment cards legally allocated to them. The Customer is deemed to have accepted that the metal card conversion process does not mean card copying or fake card production, but only involves changes in the physical properties of the existing legal card, with the acceptance of this agreement.


6. RIGHT TO SHARE ON SOCIAL MEDIA AND PROTECTION OF PERSONAL DATA

6.1 Unless explicitly and in writing requested otherwise by the Customer, Metkart has the right to share and use visuals, photographs, videos, and other visual materials related to the metal card subject to orders from the Customer, anonymized to ensure that sensitive card information, including the Customer’s identity information, card number, expiration date, security code (CVV), and name-surname, is not visible and cannot be identified, on all social media platforms, websites, printed materials, and other communication channels, including for promotion, introduction, advertising, and marketing purposes.

6.2 The Customer has the right to request the removal of content related to them by applying to Metkart with a written petition regarding the shares made under article 6.1. Metkart undertakes to fulfill this request of the data subject under the Personal Data Protection Law and to remove the relevant content from all media within a maximum of 14 (fourteen) days from the date the request is received.

6.3 Metkart processes the Customer’s personal data in accordance with the Personal Data Protection Law and relevant legislation provisions and undertakes not to share it with third parties without the Customer’s explicit consent. Detailed information on the processing of personal data is regulated in the Personal Data Protection and Privacy Policy document on the Metkart website.


7. LEGAL DISCLAIMER AND CRIMINAL LAW SCOPE

7.1 Metkart cannot be held responsible in any way for the breach of contract provisions or the failure to fulfill obligations under the contracts that the Customer has signed with their credit or bank card provider bank or financial institution. The Customer accepts that the card provider institution may not have approved the metal card conversion process and that this may constitute a breach of contract.

7.2 The Customer accepts, declares, and undertakes that the decision to purchase products or services from Metkart is entirely at their discretion and that they are fully responsible for the consequences and potential risks of this decision.

7.3 Metkart, in accordance with the Personal Data Protection Law, Bank Cards and Credit Cards Law, and other relevant legislation provisions, does not share credit card information with third parties under any circumstances and processes in accordance with data security policies.

7.4 The following applies to credit card information requested on the payment page:

  • This information is not recorded or stored on Metkart servers in any way.
  • The payment transaction takes place directly between the bank or payment institution and the Customer’s device, over a secure SSL connection, and Metkart does not provide any intermediary service in this process.
  • Data related to payment transactions is processed through systems certified with PCI-DSS (Payment Card Industry Data Security Standard).

7.5 Metkart undertakes to keep security measures related to payments at the highest level and to regularly update them in accordance with current technological developments.

7.6 Metkart reserves the right not to offer a return or exchange guarantee, even at the Customer’s request, subject to the provisions of the Consumer Protection Law and relevant legislation. This is due to the nature of the service, which is an irreversible process performed on a personal payment instrument belonging to the Customer.

7.7 The metal card service provided by Metkart is designed exclusively for personal use to improve the physical properties of the existing card and increase its aesthetic value. This service may not be officially approved by banks defined under the Banking Law or payment service providers defined under the Law on Payment Services and Electronic Money Institutions. The Customer fully accepts the risks that may arise in this context and declares and accepts that they are exclusively responsible for the consequences of these risks.

7.8 The metal card service provided by Metkart does not constitute the acts of “producing, selling, transferring, purchasing, or accepting fake bank or credit cards associated with other people’s bank accounts” as defined in criminal legislation. This is because under this service:

  • A new card is not produced; changes are made to the physical properties of the existing legal card.
  • Card information is not copied or reproduced; only the EMV chip component is physically transferred to the metal card.
  • The transaction is performed by the cardholder themselves on their own legal card.
  • The product resulting from the transaction is the original card itself; there is no fake/copy card in question.

7.9 The Customer is obligated not to commit crimes related to bank and credit cards regulated in the current criminal laws while using the metal card service provided by Metkart, and accepts and declares that all criminal and legal responsibility exclusively belongs to them in case of violation of this obligation.


8. FINAL PROVISIONS AND APPLICABLE LAW

8.1 Metkart reserves the right to change, update, or reorganize these terms of use, at its sole discretion, without any prior notice. Customers are obligated to review the current terms of use on each visit to the Metkart website, and if they continue to use the site, they are deemed to have accepted the current conditions.

8.2 The laws of the Republic of Turkey shall apply in the resolution of any disputes that may arise from this Agreement, and the Istanbul (Central) Courts and Enforcement Offices shall have exclusive jurisdiction.

8.3 If any provision of this Agreement is invalid, void, or unenforceable, the other provisions shall not be affected and shall remain in full force and effect.

8.4 This Agreement constitutes the entire agreement between the parties and replaces all previous understandings, commitments, and agreements on the subject.
